DISMISSED PROCEDURAL AMENDMENTS FOR DE NOVO
HEARINGS IN NPDES PERMIT APPEALS, R90-8
On May 7, 1992, the Board dismissed R90-8, which would have
amended the procedural rules to allow de novo hearings in
NPDES permit appeals proceedings. This proceeding was
intended to correct discrepancies between the Board's and
appellate court's disparate interpretations of the "de novo
regulation". The record accumulated in this matter indicated that
the issues involved are more complex than originally thought.
The Board believed that they would be best addressed in a
review of the entirety of the permit appeal procedural rules. The
Board further opined that legislative action might be necessary.

PROPOSED RCRA UPDATE, R92-1
On May 7, 1992 the Board proposed amendments in
R92-1, an update for USEPA revisions to the "RCRA rules",
governing hazardous waste, during the period July 1 through
December 31, 1991. The covered amendments include new
hazardous waste export rules, amendments relating to the
location of groundwater monitoring wells at interim status
facilities, and USEPA corrections to the liability insurance
regulations. The Board will accept public comments until 45
days after notices of proposed amendments appear in the Illinois

The Illinois Environmental Protection Agency, Division of Water
Pollution Control, is publishing copies of the Division's Restricted
Status and Critical Review lists at the end of this issue of the
Environmental Register. These lists reflect the status as of
March 31, 1990.
UPDATE TO ENVIRONMENTAL REGISTER MAILING LIST
The Board is updating the mailing list for the Environmental
Register. This is the second annual update of the mailing list for
the mailings of the Register. The Board desires to minimize the
impact of these mailings on our budget by assuring that only
those who desire to receive regular free copies of the Register
will appear on the list. If you would like to continue to receive it
after July 1, 1992, please fill out the address label below and
return it to the Board as soon as possible.
Those who do not

- The Board found no violation of fundamental fairness and
affirmed the Macon County Board's October 26, 1991 denial of
citing approval for Waste Hauling's Macon County facility.
Board Member J. Anderson concurred.

Platolene 500, Inc. v. IEPA - The Board
affirmed the Agency's denial of reimbursement of some costs
and remanded this matter to the Agency for reimbursement of
Platolene for $220 in rush charges plus the 15% handling
charge for the rush charge which the Agency has determined to
be eligible for reimbursement for Platolene's White County
facility.

petitioner a provisional variance that will allow Advance Excello
to accumulate hazardous waste at its Cook County facility
longer than the 90 days allowed under the hazardous waste

Oak Grigsby v. IEPA - The Board accepted
the Agency Recommendation and granted the petitioner a
provisional variance that will allow Oak Grigsby to accumulate
hazardous waste at its McHenry County facility longer than the
90 days allowed under the hazardous waste regulations.

IEPA v. Omer Thomas - The Board granted
the Agency's motion to file instanter and assessed Omer
Thomas hearing costs in the amount of $776.50 payable to the
General Revenue Fund for his Shelby County facility.

IEPA v. Arthur Miller - The Board found
Arthur Miller violated Sections 21(q)(1) and 21(q)(3) of the Act
at his LaSalle County facility and imposed a $1,000 fine
payable to the Environmental Protection Trust Fund.

its own motion the Board dismissed this matter for failure to

In order to comply with 35 Illinois Administrative Code Section 306.401 Illinois Pollution Control Board
Regulations, the Illinois EPA has prepared the following list of facilities which are on Restricted Status.
Restricted Status is defined as the Agency determination that a sewer or lift station has reached hydraulic
capacity or that a sewage treatment plant has reached design capacity, such that additional sewer connection
permits may no longer be issued without causing a violation of the Act or Regulations. Please note that the
list is continually being revised to reflect the current situation. Therefore, if you have any questions on
the capability of a treatment facility or transport system, please contact this Agency for a final
determination. This listing reflects the status as of March 31, 1992.
Facility names followed by an asterisk (*) indicates that construction is underway to ultimately alleviate
problems which resulted in imposition of Restricted Status.
