ORDER OF THE BOARD

This matter is before the Board on
a motion for voluntary
dismissal filed by the complainant, Robert Miehle
(Niehie)
on
March 10,
1995.
The underlying complaint alleged that
respondent, the Chicago Bridge and Iron Company
(CBI), violated
415 ILCS 5/21(e)
of the Environmental Protection Act for failure
to dispose waste at an approved faciltiy and for failure to
undertake corrective action regarding an alleged release of
petroleum from underground storage tanks.
On March 10,
1995,
both Miehle and CBI also jointly filed a stipulation of
settlement and a request that the Board accept and approve the
agreement making it an enforceable Board order.

The Board has reviewed the settlement agreement proffered by
the two parties and finds the agreement to be an acceptable
resulution of this private enforcement action.
The Board herein
incorporates the Stipulation and Proposal for Settlement as
submitted by the parties on March 10,
1995.
While the Board makes no findings of fact or conclusions of
law, based on the parties assurances and affirmations, we dismiss
this matter and hereby direct the parties to effectuate their
agreement.
The docket in this matter is hereby closed.
