ORDER OF THE BOARD (by C.A. Manning):

On September 5, 2002, the Board, at the parties’ request, extended until December 1,
2002, the time period within which Whole Sale Oil Company (petitioner) may appeal a July 24,
2002 determination of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS
    5/40 (a)(1) (2000),
    amended by
    P.A. 92-0574, eff. June 26, 2002; 35 Ill. Adm. Code 105.406.
The Agency modified the proposed budget for the high priority corrective action plan regarding a
leaking underground storage tank at 4540 West Augusta in Chicago, Cook County. Because the
petitioner failed to timely file an appeal, the Board dismisses this case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on December 5, 2002, by a vote of 6-0.

    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
