BOARD BUDGET FINALIZED FOR FISCAL YEAR 1993
In the last issue of the Environmental Register, the Board
posed several programmatic consequences of funding cuts that
had been proposed by the legislature. At the end of the
legislative session, many of the funding cuts were rescinded. In
addition, the legislature authorized the Board to receive
increased funding from the Permit & Inspection Fund (PIF).
Due to these changes, the Board expects to meet its
normal hearing obligations and to restore a portion of its
scientific/technical support function in fiscal year 1993, which
began July 1, 1992. However, several possibilities still exist that
could force the Board to delay hearings unless additional
resources are provided. Such possibilities include a greater than
expected number of Clean Air Act rulemakings, a large increase
in enforcement cases due to the pending People v. NL Industries
case, and a shift in the Board's caseload to more resource
intensive cases.
RULEMAKING UPDATE
RULEMAKING UPDATE
DEADLINE EXTENDED IN SDWA UPDATE, R91-3
On June 23, 1992, the Board entered an order in the Safe
Drinking Water Act (SDWA) update that includes USEPA
regulations adopted during the period from January 1 through
June 30, 1991. Basically, USEPA adopted the "Phase II" and
certain microbiological rules during this time-frame. The Board
adopted a proposal for public comment on March 11, 1992. The
Board's order effectively extends the deadline for final Board
action in this matter until October 1, 1992. The reasons stated
for the delay in adoption of a final rule are unusual difficulties in
adapting the federal rules to the Illinois format, the numerous
public comments received, and the delay in receiving answers to
several questions addressed to USEPA. Questions should be

DEADLINE EXTENDED IN RCRA UPDATE, R92-1
On June 23, 1992, the Board entered an order in the Resource
Conservation and Recovery Act (RCRA) update that includes
USEPA regulations adopted during the period from July 1
through December 31, 1991. Basically, USEPA adopted
changes to the groundwater monitoring requirements for interim
status facilities. The docket includes Board-initiated revisions to
the corrosivity characteristic test used for hazardous waste
determinations. The Board adopted a proposal for public
comment on May 7, 1992. The Board's order effectively extends
the deadline for final Board action in this matter until September
3, 1992. The reasons stated for the delay in adoption of a final
rule are the unusual size of the dockets in R91-3, the presently
pending SDWA update, and R91-13, the recently-adopted,
previous RCRA update, and the numerous corrections ultimately
effected to R91-3. Questions should be directed to Morton

APPEAL UPDATE
FIFTH DISTRICT REVERSES BOARD IN LANDFILL SITING
APPEAL, PCB 90-137
The Fifth District Appellate Court reversed and remanded the
Board's decision in Worthen, et al v. Village of Roxana (Nov. 29,
1991) PCB 90-137. In Laidlaw Waste Systems, Inc. v. PCB
(June 18, 1992), the court determined that the Board erred when
it determined that the Village of Roxana did not have jurisdiction,
pursuant to Section 39.2(m) of the Environmental Protection Act,
to approve an application for expansion of a local landfill because
it was "substantially the same" as one filed within two years.
Laidlaw's predecessor in interest had filed an application for local
approval of the facility with Madison County on August 19, 1987.
The county denied the application on February 8, 1988. The
Laidlaw subsequently acquired the property, and the Village of
Roxana annexed it. Laidlaw filed a new application for approval
of an expansion with the Village on January 2, 1990. The Village
granted siting approval, but the Board reversed when several
intervenors appealed. Laidlaw appealed the Board's decision to
the Fifth District, which reversed and remanded the matter to the
Board.
The appellate court agreed with the Board that the January 2
application was filed within two years of the earlier application
because it is the date of the prior decision that controls under
Section 39.2(m), and not the date of the earlier filing. However,
the court determined that the Board erred when it decided that
the earlier application was "substantially the same" as the earlier
application. The court concluded that the Board had conducted a
de novo
review of the record on this point, rather than adhering
to the "manifest weight" standard of review of the local approval.
The court concluded that the Board erred when it held that an
application involving an expansion of the same facility was
"substantially the same" as a matter of law. Justice Harrison
dissented from the court's decision. He would have reversed the
Board's decision outright and made the "substantially the same"
determination based on the face of the earlier and later
applications as a matter of law.
FIRST DISTRICT UPHOLDS BOARD LANDFILL RULES, R88-
7
A June 11, 1992 decision by the First District Court of Appeals,
in Waste Management of Illinois, Inc. v. PCB, (June 11, 1992),
upheld the Board's non-hazardous waste landfill rules (35 Ill.
Adm. Code 810-815). The Board adopted a comprehensive new
set of landfill rules on August 17, 1990, in docket R88-7. The
Board had directed its own Scientific and Technical Section to
review the record of an earlier dismissed rulemaking proceeding
and derive its own proposal for Board rulemaking. Therefore,
Board staff acted as the proponent for the rules ultimately

adopted by the Board. Waste Management of Illinois appealed
the rules to the First District, challenging them on several bases.
The First District affirmed the Board in part and reversed in part.
Waste Management agreed with most of the rules involved, but
it challenged certain provisions as arbitrary and capricious. The
provisions challenged on this basis relate to ambient air and
groundwater monitoring, a 100 year guarantee of groundwater
quality within 100 feet of the landfill, and a requirement that
landfill gas processing centers remain under the control of the
landfill operator under certain circumstances. Waste
Management challenged certain others of the rules as beyond
the Board's statutory authority. These included landfill
construction quality assurance, a gross revenue financial
assurance test for commercial landfills, a provision for
reconsideration by the Illinois E.P.A. of its landfill permit
decisions, and a provision for unilateral modification of landfill
permits by the E.P.A. under certain circumstances. Waste
Management further challenged the Board's use of its own staff
to develop and propound the rules.
The court reversed two rules as beyond the Board's authority.
The court held that the provision for E.P.A. reconsideration
delayed finality of E.P.A. determinations in derogation of the
statute. It felt that the Environmental Protection Act imposes a
deadline for such permit decisions, and the provision for
reconsideration was open-ended. The court also held that the
ambient air monitoring requirement, which incorporated a list of
air toxics that the Board had not yet promulgated, was beyond
the Board's statutory authority. It felt that inclusion of a reference
to rules not yet promulgated did not allow public hearing and
comment on the monitored species. The First District rejected all
other legal and factual arguments and upheld all other provisions
of the regulations.

ADJUSTED STANDARDS DETERMINATIONS LIST
Pursuant to Section 28.1(d)(3) of the Environmental Protection
Act, the Board is publishing in this issue of the Environmental
Register a list of all final determinations on adjusted standards
made within fiscal year 1992 (July 1, 1991 through June 30,
1992). Accompanying that listing is a list of all final
determinations on combined sewer overflow exceptions during
the fiscal year. To receive a copy of any of these determinations,
please write to the Clerk of the Board and specify the docket
number of the case.
PUBLIC WATER SUPPLIES RESTRICTED STATUS AND
CRITICAL REVIEW LISTS
The Illinois Environmental Protection Agency, Division of
Public Water Supplies, Permit Section, is publishing copies of
the Division's Restricted Status and Critical Review lists in this
issue of the Environmental Register. The lists are being
published at the end of this issue as part of the quarterly
notification to the public. The lists have been slightly modified to
reflect changes made since the previous publication in the April
8, 1992 issue.
UPDATE TO ENVIRONMENTAL REGISTER MAILING LIST
The Board is updating the mailing list for the Environmental
Register. This is the second annual update of the mailing list for
the mailings of the Register. The Board desires to minimize the

Illinois Asphalt Company's request for relief from the imposition
of $ 1,225.01 in hearing costs assessed against John Vander by

Harvey - The Board entered an order construing the appellate

corrective action cost from an unregistered 750 gallon gasoline
tank removed from Deerpath Golf Course was ineligible for

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in violation of 35
Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a violation of any of
the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B and C; maintenance of
adequate pressure on all parts of the distribution system under all conditions of demand; meeting raw water quantity requirements of
35 Ill. Adm. Code 604.502; or maintenance of treatment facilities capable of providing water "assuredly adequate in quantity" as
required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for certain limited
situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board for the violation, or from permit
issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any
public water supply should be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of
July 1, 1992.

Critical Review List -- Public Water Supplies

The Critical Review List was developed to give additional notification to officials of public water supplies which may be close to being
in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the violations which
would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any
public water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of July 1, 1992.

ENVIRONMENTAL INFORMATION SERVICES
AVAILABLE FROM THE BOARD
The Board has the following information available:
SUBSCRIPTION SERVICE OF BOARD OPINIONS AND ORDERS.
The subscription service comprises all the
Opinions and Orders issued by the Pollution Control Board in a fiscal year (July 1 through June 30). The Board
meets approximately twice monthly in order to issue Opinions and Orders.. Usually no later than the 15th day of
each month, a volume is issued containing the Opinions and Orders of the Board from the preceding month.
Two formats will be offered starting July 1 of this year (FY93): a hard paper copy for $350.00 per year and an
electronic version for $275.00 per year. The electronic version will consist of Opinions and Orders in the
WordPerfect 5.1 (DOS) format on either 3.5" or 5.25" inch diskettes. The electronic format will allow for word
searches and other useful tools provided by the WordPerfect software.
When ordering, please specify the choice of either the hard copy or electronic version. If ordering the electronic
version, please specify 3.5" or 5.25" diskettes.
LANDFILL REGULATIONS.
This consists of the Board's landfill regulations and other supporting background
documentation. This is offered only in an electronic version which consists of WordPerfect 5.1 (DOS) on either 3.5"
or 5.25" inch diskettes. The electronic format will allow for word searches and other useful tools provided by the
WordPerfect software. The cost is $100.00.
When ordering, please specify the choice of either the 3.5" or 5.25" diskettes.
