CONCURRING OPINION (by J. Theodore Meyer):
I concur with the majority’s action in this matter.
I
support the majority’s reasoning and conclusions, but concur to
make an additional point.
Government acts for the common good of the people, and
cannot endanger the good of the majority in order to placate a
minority.
The siren at issue here serves a number of functions
which protect the common good——tornado warning, calling
volunteers to fires and medical emergencies, warning traffic that’
‘emergency vehicles will soon be entering the road.
I cannot see
how the inconvenience and discomfort apparentl~:suffered by a
minority of residents, three times a week during daytime hours,
could ever outweigh the purposes served by the siren.
We do not
live in a “zero risk” society.
Accommodations must sometimes be
made by a minority to advance the safety and welfare of others.
Therefore,
