HEARING OFFICER ORDER

 

On June 17, 2004, a telephonic status conference was held. The respondent informed the

hearing officer that the 45-day comment period from the United States Environmental Protection

Agency regarding the modified permit has expired, but that it will check to make certain that no

comment was tendered. If approved, the respondent will issue a permit and the petitioner will

file a motion to voluntarily dismiss this matter.

 

The parties are directed to participate in a telephonic status conference with the hearing

officer on August 12, 2004, at 10:15 a.m. The status conference must be initiated by the

petitioner, but each party is nonetheless responsible for its own appearance. At the status

conference, the parties must be prepared to discuss the status of the above-captioned matter and

their readiness for hearing. If, however, the petitioner files a motion to dismiss prior to the next

status conference, the conference will be cancelled without further notice.
