    HEARING OFFICER ORDER

On July 15, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that the related enforcement matter is close to settling
and they anticipate that a consent order will be entered within the next 21-days. Once the
consent order is entered, the petitioners anticipate that they will be filing a motion for voluntary
dismissal for the respective matters. The petitioners represented that they will file a waiver of
the statutory decision deadline to and including November 18, 2004.

The parties are directed to participate in a telephonic status conference with the hearing
officer on August 19, 2004, at 9:30 a.m. The status conference must be initiated by the
petitioners, but each party is nonetheless responsible for its own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matters and
their readiness for hearing. If, however, motions to dismiss the respective matters are filed prior
to the next status conference, the conference will be cancelled without further order.

    IT IS SO ORDERED.
