ORDER
OF THE BOARD

This matter
is before the Board pursuant to a joint status
report filed on February 25,
1994 by General Motors Corporation,
Powertrain
Division
(“GM”)
and
the
Illinois
Environmental
Protection Agency
(“Agency”).
On November
8,
1991,
GM filed
a
permit appeal challenging conditions in an NPDES permit issued on
October 9,
1991. For the past six months, the hearing in this case
has been under continuance while,
among other things, the parties
pursue negotiations.
The status report indicates the parties are
continuing with their negotiations, that they believe an amicable
resolution of this matter is possible, and there is no compelling
reason to hold a hearing at this time.
Based
on
the
parties’
representation
that
settlement
is
probable and a hearing is not necessary, on our
own
motion, we are
hereby entering a stay in this case until August 15,
1994.
If at
a later time the parties wish to proceed to hearing, petitioner may
file a motion to lift the stay and schedule hearing.
A statutory decision deadline waiver was filed extending the
decision until December 31,
1994, therefore,
if this case has not
yet been
dismissed and the parties wish to conclude negotiations
past August 15,
1994, petitioner must file for an extension of the
stay and an additional waiver of the statutory decision deadline.
The Board requires
120 days
in which
to schedule hearing,
give
public notice, establish a briefing schedule, receive and review
the transcript and fully deliberate on the matter.
Under such time
constraints, the Board will be required to direct that this matter
be
scheduled
for
hearing
in
August
without
a
waiver
of
the
statutory deadline.
