ORDER OF THE BOARD

This matter comes before the Board upon filing by the City
of Morris
(“Morris”) on December 2,
1991 of a motion to modify
Board Order.
On January 8,
1992 the Illinois Environmental
Protection Agency
(“Agency”)
filed a response requesting that the
motion be granted.
On January 9,
1992 the Board issued an order
noting that facts asserted in the motion are not of record and
were
not supported by affidavit as required by the Board’s
procedural rules.
On January
17,
1992 Morris filed an affidavit
attesting to the facts at issue.
Morris requests that the Board extend the date for filing of
an amended petition for exception from November
1,
1991 to
November
1,
1992.
The date for filing of the amended petition is
contained in condition #4 of the Board’s April
7,
1988 Opinion
and Order
(88 PCB 5).
In support of this motion,
Morris, among
other matters,
states that insufficient rainfall during 1991 has
prevented it from collecting data necessary to complete its
petition.
Morris has thus been unable to fully characterize the
overflow frequencies,
strengths,
durations, and potential
environmental impacts.
The additional year is intended to
provide time to collect these data.
The Agency believes that granting the one—year extension
would be prudent and justified under the existing extraordinary
circumstances.
Morris’ motion to modify the date in the Board’s Order in
this matter of April
7,
1988 at condition #4 from November
1,
1991 to November 1,
1992,
is hereby granted.
