This matter is before the Board pursuant to a status report
filed by Reynolds Metal Company
(Reynolds)
on March 22,
1995.
On
March 16,
1995,
the Board accepted Reynolds March
8,
1995 status
report which indicated Reynolds awaited U.S.EPA’s final
promulgation of a site—specific control requirement for Reynold’s
aluminum rolling operations and extended the stay in this case
until June 15,
1995.
In our order we requested the petitioner to
file the appropriate motion lifting the stay if the U.S.EPA
approved the rule prior to the next status report due date.
On
March 22,
1995, Reynolds filed a status report stating that the
rule had been approved and published in the
Federal Register
on
March 10,
1995
(60 Fed.
Reg.
13042)
and that Reynolds and the
Illinois Environmental Protection Agency,
a co-petitioner in this
proceeding, are ready to resume the hearing process.
The stay is hereby lifted and as this case was accepted for
hearing by the Board on January 23,
1992, at this juncture we
need only assign a hearing officer.
This case is directed to
hearing and the parties will be contacted by a hearing officer in
the near future regarding a hearing schedule.
