    ORDER OF THE BOARD

    This matter is before the Board on status report filed on
    May 19,
    1993,
    by Ashland Chemical Inc.
    (Ashland).
    In its report
    Ashland states that this appeal was filed on November
    4,
    1991, to
    contest four conditions in a permit.
    Three of those conditions
    relate to the operation of a new storage facility and one relates
    to the remedial activities which had been included as interim
    measures in the permit.
    Ashland states that the Illinois
    Environmental Protection Agency
    (Agency) has verbally agreed with
    the concern regarding the interim measure language and that this
    portion of the appeal can be resolved by agreement.
    Ashland also reports that since the time of the last status
    report the Agency has approved its closure plans with regard to
    three hazardous waste tanks but has not yet issued a modified
    permit.
    Additionally, Ashland states that the parties are
    continuing their discussions regarding a modified permit but that
    the Agency believes the process will take an additional three
    months to complete.
    Finally, Ashland states that the Agency has
    reviewed the status report and has no objections.
    The Board notes that Ashland has provided a limited waiver
    of the Board’s decision deadline until December 27,
    1993.
    To
    allow adequate time for the filing of briefs and Board
    deliberation before the deadline, the Board requires that
    hearings be scheduled approximately 120 days prior to the
    decision deadline.
    It
    is the responsibility of the petitioner to
    provide adequate waivers and proceed with the matter in a timely
    manner.
    The parties are hereby directed to file their next
    status report on or before August 20,
    1993.
    In the event that
    this case has not been dismissed,
    an additional waiver must be
    supplied to the Board or this matter will be set for hearing.
