This matter is before the Board on its own motion.
This
petition was filed with the Board on November
1,
1991.
No
substantive action has taken place in this case.
On March 9,
1993, petitioner, with the agreement of the Illinois
Environmental Protection Agency, filed a status report.
Petitioner states that it previously filed a waiver of the
decision deadline to allow time for meaningful settlement
negotiations, that the parties have had several meetings and
numerous telephone conferences and have made substantial progress
in resolving denial points, and that the appeal remains in a
settlement postrue and is likely to be resolved.
This status report,
filed 16 months after the appeal was
filed,
is insufficient.
There is no indication of the number or
types of denial points which may have been resolved,
or of when
this case may be concluded.
Petitioner
is directed to file a
more complete status report, setting forth specific details and
an estimated time when this case might be resolved, within 30
days of the date of this order.
Failure to do so will subject
the petition to dismissal for want of prosecution.
