ORDER OF THE BOARD
(by J. Theodore Meyer):
On January
5,
1995,
petitioner Acme Steel Company
(Acme) and
respondent the Illinois Environmental Protection Agency (Agency)
filed a joint status report in this proceeding.
The parties
recount the progress on Acme’s petition for adjusted standard (AS
94-8), which would,
if granted, resolve this case with regard to
the thermal permit limitations.
The parties state that the
Agency filed its recommendation on November 28,
1994,
recommending that the requested adjusted standard be granted,
subject to conditions.
In regard
to
the
issues
in
this
case
which are not the subject of the adjusted standard petition, the
Agency intends to issue a draft permit addressing those issues.
However, the parties state that the draft has not been issued due
to personnel shortages at the Agency, and because the draft
permit will have to address the Board’s decision in the adjusted
standard petition, when that decision is made.
The parties ask
that this matter be stayed until resolution of the pending
adjusted standard petition, “with the additional consideration
that USEPA response time may require another motion for a stay of
these proceedings.”

The Board accepts the status report.
We will extend the
current stay until June 15,
1995.
However, although we are
sympathetic to the efforts to resolve this dispute through
negotiation, we will not indefinitely delay substantive action on
this proceeding, which began almost four years ago.
The parties
are directed to file an additional status report no later than
June 5,
1995.
We expect to see concrete progress in the adjusted
standard proceeding.
