ORDER OF THE BOARD
(by J. Theodore Meyer):
This matter is before the Board on the parties’
joint status
report filed on June
6,
1995.
The parties state that they have
worked together to resolve several permit denial issues while
awaiting the outcome of a related matter, AS 94-8, which will
resolve the permit conditions regarding thermal discharges.
The
parties noted that hearing on AS 94-8 was held on April
10,
1995,
with post-hearing comments filed on May 25,
1995.
After AS 94-8
is decided, the Illinois Environmental Protection Agency
(Agency)
intends to issue a draft permit to Acme Steel.
The parties then
suggested that this matter be stayed until the resolution of the
Adjusted Standard petition in AS 94-8.
The joint status report is hereby accepted and the Board
grants a 60-day stay in this matter.
The parties are directed to
file another status report on or before August
7,
1995.
The
report shall include a synopsis of the activity in this
consolidated appeal, and include an estimated time when the case
might be resolved.
Failure to file the status report in a timely
manner will subject the petition to dismissal for want of
prosecution.
IT IS SO ORDERED.
