ORDER OF THE BOARD (by N.J. Melas):

On June 9, 2005, complainant, the People of the State of Illinois (People), filed a motion
to voluntarily dismiss this 10-count air enforcement action against GTC, International, Inc.
(GTC International) without prejudice. On March 3, 2005, the Board granted the People’s
motions to deem facts admitted and for summary judgment. The Board further directed the
parties to address the issue of remedies at hearing or in briefs.

The People state that GTC International filed for bankruptcy on November 1, 2004. In
light of the respondent filing for bankruptcy, the People state that further enforcement
proceedings would not be a productive use of either the People’s or the Board’s resources, and
therefore seeks to dismiss GTC International. The Board grants the People’s motion and closes
    the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on June 16, 2005, by a vote of 5-0.
