    (Variance - Water, NPDES)
    ORDER OF THE BOARD (by N.J. Melas):
    On July 28, 2000, petitioner Ameren Energy Generating Company filed a variance petition for its Grand
    Tower Power Station (Station). The Station discharges its wastewater into an unnamed tributary of the Mississippi
    River in Jackson County, Illinois. Petitioner seeks a variance from the Board’s general use water quality standard for
    boron at 35 Ill. Adm. Code 302.208(g). Petitioner also requests a variance from the Board’s effluent standard for
    boron at 35 Ill. Adm. Code 304.105. The variance is requested for a period of three years from the date of the final
    order.
    As petitioner has waived its right to a hearing pursuant to 35 Ill. Adm. Code 104.124, the Board vacates its
    August 10, 2000 order in this matter. The Board will proceed to decision after receipt of the Agency
    recommendation.
    Unless otherwise ordered by the hearing officer, the Illinois Environmental Protection Agency’s deadline for
    filing a recommendation with the Board shall be 30 days from the date of this order.
