OPINION AND ORDER OF THE BOARD (by N.J. Melas):

 

 Pursuant to Sections 7.2 and 13.3 of the Environmental Protection Act (Act) (415 ILCS 5/7.2 and 13.3 (1998)), the Board proposes amendments to the Illinois wastewater pretreatment regulations. Section 13.3 of the Act provides for quick adoption of regulations that are identical-in-substance to federal wastewater pretreatment regulations adopted by the United States Environmental Protection Agency (USEPA) pursuant to Sections 307(b), (c), and (d) and 402(b)(9) of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C. §§ 1317(b), (c), (d), 1342(b)(9) (1996)). Section 13.3 of the Act also provides that Title VII of the Act and Section 5 of the Administrative Procedure Act (APA) (5 ILCS 100/5-35 and 5-40 (1998)), do not apply to this rulemaking. Accordingly, this rulemaking is not subject to first or second-notice review by the Joint Committee on Administrative Rules (JCAR).

 Section 7.2(b) of the Act (415 ILCS 5/7.2 (1998)) requires the Board to complete its identical-in-substance rulemaking actions within one year of the date of the earliest federal amendments involved in a docket. In this docket, the earliest federal action requiring Board action occurred on January 19, 2000. Thus, the Board must complete its rulemaking activity in this docket prior to January 19, 2001.

FEDERAL ACTIONS CONSIDERED IN THIS RULEMAKING

 This proposed rulemaking incorporates certain federal amendments that occurred during the period of January 1, 2000, through June 30, 2000. The federal wastewater pretreatment regulations are found at 40 C.F.R. §§ 400-499, interspersed throughout the federal wastewater effluent discharge rules. The USEPA amended its wastewater pretreatment regulations five times during that period: January 19, 2000; January 27, 2000; March 16, 2000; March 21, 2000; and May 23, 2000. This rulemaking incorporates all of these actions.

The federal amendments incorporated into this rulemaking are summarized as follows:

The USEPA adopted wastewater effluent limitation guidelines, pretreatment standards, and new source performance standards for the commercial hazardous waste combustor subcategory of the waste combustors point source category.

 

Correction to Effluent Limitations Guidelines, Pretreatment Standards, and New Performance Standards for the Landfills Point Source Category . The USEPA corrected its January 19, 2000 (65 Fed. Reg. 3008) effluent guidelines, pretreatment standards, and new source performance standards for the landfill point source category.

 

Amendment to Effluent Limitations Guidelines, Pretreatment Standards, and New Performance Standards for the Builder’s Paper and Board Mills Point Source Category. The USEPA removed its April 15, 1998 (63 Fed. Reg. 18504) effluent guidelines, pretreatment standards, and new source performance standards for the builder’s paper and board mills point source category in 40 C.F.R. 431.

 

Correction to Effluent Limitations Guidelines, Pretreatment Standards, and New Performance Standards for the Commercial Hazardous Waste Combustor Subcategory of the Waste Combustors Point Source Category. The USEPA corrected its January 27, 2000 (65 Fed. Federal Action

The USEPA adopted wastewater effluent limitation guidelines, pretreatment standards, and new source performance standards for the landfill point source category on January 19, 2000 (65 Fed. Reg. 3008). The regulation establishes technology-based effluent limitations for wastewater discharges associated with the operation and maintenance of new and existing hazardous and non-hazardous landfills regulated, respectively, under Subtitle C and Subtitle D of the Resource Conservation and Recovery Act (RCRA) (42 U.S.C. §§ 6901 et seq. (1998)). Sources of landfill wastewater include, but are not limited to, landfill leachate and gas collection condensate. One segment of the rulemaking was the amendment of Methods 625 and 1625 in 40 C.F.R. 136.3, Appendix A.

The USEPA adopted minor technical corrections to effluent limitation guidelines, pretreatment standards, and new source performance standards for the landfill point source category on March 16, 2000 (65 Fed. Reg. 14344). Persons interested in a more detailed discussion of the January 19, 2000, and March 16, 2000 federal actions should refer to the cited Federal Register notices.

Amendment to Board Rules

The Board incorporates these amendments into its rules by adding “Subpart BT Landfills” to the Part 307 Sewer Discharge Criteria. The Board also amends a single incorporation by reference to 40 C.F.R. 136 in the “Incorporations by Reference” Section found at 35 Ill. Adm. Code 310.107(b).

Federal Action

The USEPA adopted wastewater effluent limitation guidelines, pretreatment standards, and new source performance standards for the commercial hazardous waste combustor subcategory of the waste combustors point source category on January 27, 2000 (65 Fed. Reg. 4360). The regulation generally applies to hazardous waste combustion facilities, except cement kilns, regulated as “incinerators” or “boilers and industrial furnaces” under RCRA (42 U.S.C. §§ 6901 et seq. (1998)) under certain conditions.

March 21, 2000: Removal of Effluent Limitations Guidelines, Pretreatment Standards, and New Performance Standards for the Builder’s Paper and Board Mills Point Source Category

Federal Action

The USEPA removed its April 15, 1998 (63 Fed. Reg. 18504) effluent guidelines, pretreatment standards, and new source performance standards for the builder’s paper and board mills point source category in 40 C.F.R. 431 on March 21, 2000 (65 Fed. Amendment to Board Rules

In Section 307.1503, the Board is amending the text of the title of the section to “Cultured Products” from “Seasoned Products” to reflect the correct title in the table of contents and in corresponding 40 C.F.R. 405.30. In the table of contents, the Board is adding “307.6505 Repackaging of Agricultural Pesticides Performed at Refilling Establishments” which corresponds to the text of the regulations. The Board also changed a colon to a semicolon after “July 12, 1999” in the source note. These changes are being made in response to a suggestion from JCAR, made on September 25, 2000. Public Comments

The Board will accept public comments in this matter for a period of 45 days after publication of the proposed amendments in the Illinois Register. After the expiration of the 45-day public comment period, the Board will proceed to adoption of the regulations based on this proposal on or before the January 19, 2001 completion date specified by Section 7.2(b) of the Act.
