This matter comes before
the Board upon an April
14,
1986,
complaint filed
by the Illinois Environmental Protection Agency
(‘~Agency”). The complaint alleges that Chicago Steel Container
Corporation
(“CSCC”)
violated numerous
sections of
the Act and
Board air pollution regulations due
to Respondent’s
failure to
obtain construction and operating permits for the painting
booths,
lining booths, main paint and lining baking oven,
and
drying ovens
found at
its 1846 South Kilbourn Avenue, Chicago,
facility.
Hearing was conducted
in this case on September
4,
1986, and
continued on the record until September
18,
1986,
at which time
it was recommenced.
At the hearing held on the latter date,
the
parties
indicated that this matter had been settled,
and
presented
a Stipulation of Facts and Proposed Settlement for
Board approval.
At that time,
the document had not been signed
by representatives
of either party, although both parties
acknowledged an intention to do
so.
More
than seven months have elapsed since
the September
18,
1986 hearing, but the Board has yet to receive
a signed copy of
the Stipulation of Facts and Proposed Settlement.
The Board will
assume this matter
is not settled,
and proceed to set it for
hearing,
if such
an agreement,
signed,
is not received by the
Board by June
1,
1987.
