HEARING OFFICER ORDER
On July 14, 2005, the petitioner informed the hearing officer that a settlement has been
reached and that a no further action letter has been issued. The actual reimbursement, however,
has yet to be disbursed. Petitioner represented that it will file a 60-day waiver of the statutory
decision deadline.
 
The parties are directed to participate in a telephonic status conference on
September 29, 2005, at 12:00 p.m. The status conference must be initiated by the petitioner, but
each party is nonetheless responsible for its own appearance. At the status conference, the
parties must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, motion to voluntarily dismiss is filed prior to the next status
conference, the conference will be cancelled without further order.
