ORDER OF THE BOARD

This matter comes before the Board on a motion for
continuance
of this variance proceeding made by petitioner
at
hearing held in
this matter on July
30,
1985.
The continuance
is
requested for
the
time period
necessary for the Agency
to
determine whether
to grant petitioner
an operating permit
(plus
14 days,
if denied)
which
if issued would obviate the need
for
variance relief.
Petitioner has committed
to apply for
such
permit by September
1,
1985 and has waived decision
in this
matter
until March
27, 1986.
Accordingly,
the motion
is granted
and this matter
is continued until
the Agency has made
a permit
determination but in no event
shall continuance extend beyond
January 15,
1986.
The parties shall
apprise the Board
once
a
permit decision has been made, and
if denied,
a hearing shall
be
scheduled on the variance petition within
two weeks of denial.
