HEARING OFFICER ORDER

On December 9, 2004, all parties participated in a telephonic status conference with the

hearing officer. The parties were directed to submit a revised and proposed discovery schedule

on or before December 16, 2004. On December 15, 2004, the parties submitted an agreed

proposed discovery schedule. The discovery schedule is accepted to the extent as follows:

respondent to respond to the outstanding September 15, 2003 discovery request on or before

January 14, 2005; respondent to serve written discovery requests on or before January 14, 2005;

complainant to respond to respondent’s written discovery requests on or before February 15,

2005; parties to disclose expert and opinion witnesses on or before March 4, 2005; discovery

closes on June 17, 2005; dispositive motions to be filed on or before July 15, 2005.

The parties or their legal representatives are directed to participate in a telephonic status

conference with the hearing officer on January 27, 2005, at 10:00 a.m. The telephonic status

conference must be initiated by the complainant, but each party is nonetheless responsible for its

own appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing.
