ORDER OF THE BOARD
(by J.D.
Dumelle):
On June 5,
1981 the Village of Wauconda
(Village) filed
a motion for reconsideration of the Board’s May
1,
1981 Opinion
and Order which denied the requested variance.
In support
of its motion the Village has presented new information regarding
its sewage treatment plant.
It also requests hearing.
The Board cannot allow the Village to have “two bites
at the apple” in a single proceeding.
Hearing in this matter
had been properly waived and it was only upon an adverse determ-
ination by the Board that hearing was requested.
Therefore,
the motion for reconsideration and hearing
is hereby denied.
If the Village presents a new petition
for variance which alleges new information,
the Board will
consider it in that context.
IT
IS SO ORDERED.

Control Boafd~hereby c~rtifythat the above Order was adopted
