    RESOLUTION AND ORDER OF THE BOARD

    This Resolution and Order constitutes
    the Pollution Control
    Board’s formal
    response to the objection of the Joint Committee
    on Administrative Rules
    (JCAR)
    dated June
    23,
    1986,.
    This
    response
    is made
    in accordance
    with
    Section 7.06 of the Illinois
    Administrative Procedure
    Act,.
    In its June 23,
    1986,
    letter
    of objection JCAR objects
    to
    all or portions of 35 Iii.
    Adrn. Code 212.121, 212.123, 212.124
    and 212.126.
    These
    rules constitute
    the entirety of the
    amendments
    to the opacity limitations as proposed
    in Docket B.
    None
    of the rules proposed
    in Docket A have been the subject of
    any objection.
    Furthermore, USEPA has indicated that the opacity
    rules,
    as presently proposed,
    could
    not be approved as
    a revision
    to the State Implementation Plan.

    Given
    these occurrences,
    the Board has determined that
    it
    is appropriate
    to withdraw its proposal
    to amend Sections
    212.121,
    212.123, 212,124 and 212.126 while proceeding
    to final
    adoption of the remaining particulate rules.
    The Board
    has today
    adopted the particulate rules and will
    file them concurrently with its notice of withdrawal
    of the
    opacity rules
    to the Secretary of State and JCAR.
