ILLINOIS ENVIRONMENTAL PROTECTION AGENCY,
Respondent.
ORDER
OF THE BOARD
(by
3.
Anderson):
On March 19,
1981 the Board granted James Noble a variance
from Rule 962(a) of Chapter
3.
On October 6,
1981 the Board
received a letter from Noble indicating that he is considering
a suggestion to change the orientation of the building and to
extend it onto a yet—to-be purchased adjoining lot,
in order
to protect the occupants from nearby noise.
The Board construes this letter as a motion for
reconsideration of its March 19,
1981 Order,
which is denied
as untimely.
A petition for variance which complies with the
requirements of Procedural Rule 401 should be submitted to the
Board prior to any construction which is not in accordance with
the plans submitted to the Board in PCB 80—215.
IT IS SO ORDERED.
I,
Christan

Clerk of the Illinois Pollution
Control Board, hereby ~e~tify that the above Order was a4opted on
