    ORDER OF THE BOARD

    On February
    2,
    1981,
    the City
    of Marquette Heights
    (City)
    filed a petition for variance from Rule 604(b)
    of Chapter
    3:
    Water Pollution.
    That petition neither requests nor waives
    hearing
    as required by Procedural
    Rule
    401(b).
    If hearing
    is
    to be waived,
    such waiver must be accompanied by an affidavit
    swearing to the truth of the facts alleged in the petition.
    Further,
    the Board hereby orders that the city join the developer
    for outlet H as a party to this action pursuant to Procedural
    Rules 309 and 303(c).
    If these defects are not cured by the filing of an amended
    petition within 45 days of the date of this Order,
    the
    petition
    will be subject to dismissal.
