This matter comes before the Board upon various motions
to
dismiss filed between June
6
and June
13, 1986,
on behalf
of each
of
the remaining respondents
to this action.
No response has
been filed by the Americans for
a Clean Environment
(ACE).
However,
based upon
a telephone inquiry to Georgia Dunn, one of
the representatives
of that group,
it appears that ACE has not
understood
its right
to respond
to those motions,
but that it
does wish
to file a response.
In order
to insure that ACE may
fully present its reasons
why the motions
to dismiss should
be denied, the Board will not
decide those motions at this time.
However, the Board will
decide those motions at its July 31 1986, Board meeting
regardless of whether
a response
is filed.
Any such response
should be received by the Board on or before July 29, 1986.
