    ORDER OF THE BOARD
    (by Mr.
    Dumelle):
    Petitioner is hereby granted a variance from Rules 404
    and 408(a)
    as
    it pertains to cadmium, copper,
    cyanide, iron
    (total),
    lead, chromium
    (total hexavalent), chromium
    (total
    trivalent),
    nickel, manganese,
    and zinc of Chapter 3:
    Water
    Pollution for 60 days from the date of this Order subject to
    the following conditions:
    a)
    The variance shall only apply on weekends when bypassing
    is necessary because of construction.
    b)
    During bypassing, effluent from Petitioner’s facility
    shall be
    limited to the requested concentrations stated
    in Exhibit A to the Amended Petition.
    c)
    During the term of this variance, Petitioner shall
    perform the construction described in Paragraph 7(b) of
    the Agency’s Recommendation.
    d)
    During periods of bypassing, Petitioner shall provide
    sufficient manpower to minimize damage to the water
    quality of the Rock River.
    e)
    Petitioner shall advise
    all major industries discharging
    to its treatment plant of the work to be performed and
    solicit their cooperation to minimize any potential
    environmental damage.
    f)
    Within 45 days of the date of this Order Petitioner
    shall execute a certification of acceptance and agreement
    to be bound to the terms and conditions of this variance.
    This
    45 day period shall be held in abeyance
    if this
    matter is appealed.
    The certification shall be forwarded
    to the Illinois Environmental Protection Agency,

    62706 and shall
