PCB 83—132
DUNN CO.,
)
Respondent.
ORDER OF THE BOARD
(by J.
D, Dumeile):
This matter comes before the Board upon an April
26,
1984
motion filed on behalf of the Dunn Co. requesting that the
complaint be made more definite,
Dunn Co. had moved for
dismissal due to the lack of specificity of the complaint on
January
6,
1984,
and the Board denied that motion on January 27,
1984 stating that greater latitude is given to complaints filed
by citizens representing themselves and that greater specificity
may be available through discovery.
Dunn Co. now alleges that
William and Delores Carter are represented by Frank
H.
Byers
and again requests that the complaint be made more definite.
However, no one has entered his appearance on behalf of the
Carters and there
is no proof of service upon the Carters.
The Board,
therefore, will defer ruling upon this motion until
proof of service is filed and the time for response
has run.
IT IS SO ORDERED.
I,
Christan L, Moffett,
Clerk
of
the
Illinois
Pollution
Control Bçard hereby certify that the above Order was adopted on
