ORDER OF THE BOARD
(by J.
D.
Dumelle):
When a variance petition and a petition for an alternative
standard pursuant to Rule 204(g) have been filed as a single
document, the Board has separately docketed the petitions.
CPC
International,
Inc. v.
IEPA,
PCB 82—153, CPC International, Inc.
V.
IEPA,
PCB 83—11; Olin Corporation v. IEPA, •PCB 83—44, and
Olin Corporation v.
IEPA,
PCB 83—46.
In this instance, the two
petitions were simultaneously filed.
The variance is assigned
PCB 83—49, and the alternative standard request is docketed as
PCB 83—55.
As in the cases cited above, the same hearing officer
will be assigned to the variance petition and the alternative
standard request, and the parties are free to successively
schedule the hearings necessary to both.
Hearing
is neither waived nor requested by Petitioner on
this Variance Petition filed April 13,
1983.
Petitioner alleges
that should variance from Chapter
2:
Air Pollution Rule 204(f)
be granted,
it will not necessitate an amendment to the State
Implementation Plan (SIP).
Petitioner does not explain this
allegation.
Perhaps it
is based upon a belief that the parallel
request for an alternative standard pursuant to Rule 204(g)
is
more properly the SIP amendment,
should it be granted in PCB 83-55.
However, in the event that final action in that matter is delayed,
it is possible that the variance will have to be submitted to the
United States Environmental Protection Agency.
Therefore, on its
own motion the Board orders that hearing be set in this matter.
IT IS SO ORDERED.
I,
Christan L. Moffett, Clerk of the Illinois Pollution
Control Board, hereby certify that the above Order was adopted
