The
Illinois Pollution Control
Board
has determined that the
above named Citizens Complaint is frivolous; and therefore,
the Board
dismisses said Complaint pursuant to Procedural
Rule 306: Authorization
~rin.
Complainant alleges that Respondent has violated Sections 9(a)
and 9(b)
of the Environmental Protection Act and Rule 103(b)(2) of the
Air Pollution Regulations
by reason of failure to apply for and obtain
operating permits for
a transmission line.
The Board
has determined
that transmission lines are not required
to obtain
a permit pursuant
to Rule 1O3(b)(2) of the Air Pollution Regulations
or Sections 9(a)
and 9(b) of the Environmental
Protection Act.
Complainants have available two remedies.
The first
is
to
propose an amendment to the Air Pollution Regulations.
The second is
to instigate an enforcement action
if Complainant has
evidence that
Respondent is causing air pollution or is violating any applicable air
quality or emissions standard.
