OPINION AND ORDER OF THE BOARD (by Mr. Seaman):
This Petition for Variance was filed with the Environmental
Protection Agency (hereinafter “Agency”) on January
22, 1974 by the
Gulf & Western Metals
Forming Co.
Young Daybrook Division
(hereinafter
“Petitioner’).
The
Petitioner operates
a facility in Chicago where auto-
motive seat parts comprised of springs and frames are assembled.
The
springs and frames are electrostatically spray painted with an air
dry enamel.
Petitioner requests
a Variance froni Rule 205(f)
of the State
of Illinois Air Pollution Control
Regulations for a period of one
year from the date of the Variance Petitioner.
The Agency Recommendation
is for
a grant of the Variance
for six months based upon the following information:
1.
Petitioner cannot obtain photochemically non—reactive
solvents with which
to thin his paints because of current shortages.
This has been shown
by correspondence,
and verified by
a conversation
between
the Agency investigator and the agency of Petitioner’s principal
supplier,
Glidden Durkee, who was present at the time of the Agency
investigation.
2.
Compliance with the Alternative Standard of Rule
205(f)(l)
is not feasible for Petitioner since Petitioner
is unable
to obtain the fuel necessary to operate an afterburner.
3.
No complaints concerning the Petitioner’s facility have
been received by the Agency.

4.
Petitioner was not able to execute its otherwise
successful
Compliance Plan because of the shortage of non-
photochemical
solvents.
We concur.
However, we believe that
a longer period oF time
is necessary.
This Opinion constitutes
the findings of fact and con-
clusions of law of the Board.
IT IS THE ORDER of the Pollution Control
Board that the
Petitioner be granted
a Variance from Rule 205(f)
of the Illinois
Air Pollution Control
Regulations
•for one year from the date of
this Order.

Petitioner should be required to utilize as
much exempt solvent formulations
as can be furnished
by
its
suppliers.

Petitioner should be required
to apply for an
operating permit within
50 days of the date of the Board Order.

Within
6 months from the date of the Board Order,
Petitioner should be required
to submit to.the Agency
a modified
compliance plan to replace that which
has been nullified by shortages.
