HEARING OFFICER ORDER
On November 9, 2009, the parties participated in a telephone status conference with the
hearing officer. The hearing is set for December 7, 2009 is cancelled. This case may be resolved
without hearing because the site work is complete, and the parties are negotiating the penalty.
Additionally, complainant’s witness is unable to attend the scheduled hearing due to medical
issues.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:00 a.m. on January 13, 2010. The telephone status conference will be initiated by
the complainant.
