    HEARING OFFICER ORDER
    On October 29, 2009, all parties participated in a telephonic status conference
    with the hearing officer. The petitioner represented that the parties continue with
    settlement discussions and that it will forward a draft application to the respondent for its
    review. By agreement, the administrative record is now due to be filed on or before
    December 11, 2009. The petitioner stated that it will file an additional waiver of the
    statutory decision deadline to and including March 4, 2010.
    The parties or their legal representatives are directed to participate in a telephonic
    status conference with the hearing officer on December 1, 2009, at 9:45 a.m. The
    telephonic status conference must be initiated by the petitioners, but each party is
    nonetheless responsible for its own appearance. At the status conference, the parties must
    be prepared to discuss the status of the above-captioned matter and their readiness for
    hearing.
