HEARING OFFICER ORDER
On November 10, 2009, petitioner participated in a telephone status conference with the
hearing officer. Respondent did not appear. Petitioner is still waiting for respondent to issue a
new operating permit. Respondent’s attorney previously advised petitioner that he was still
looking at a final issue.
The parties are directed to participate in a telephone status conference with the hearing
officer at 11:00 a.m. on December 15, 2009. The status conference shall be initiated by the
petitioner.
There is an open waiver of the statutory decision deadline in this matter.
