Packaging
Personified,
Inc.,
(hereinafter,
“Packaging”),
by
and
through
its
attorneys,
and
respectfully
requests
that
the
Hearing
Officer
grant
this
motion
requesting
an
extension
of
time
to
submit
its
Post-Hearing
brief
in
this
matter.
In
support
thereof,
Packaging
states
as
follows:
1.
Pursuant
to
the
Hearing
Officer’s
order
dated
August
26,
2009,
Complainant’s
August
19,
2009
joint
motion for
extension
to
file
respective
post-hearing
briefs
was
approved.
2.
The
Hearing
Officer’s
order
provided
that
Complainant’s
post-hearing
brief
was
now
due
on
September
25,
2009,
Respondent’s
brief
due
on
October
30,
2009,
and
Complainant’s
reply
brief
was
due
on
November
20,
2009.
3.
Complainant
submitted
its
Post-Hearing
brief
on
September
25,
2009.
4.
Respondent
requires
additional
time
to
submit
its
brief
and
respectfully,
requests
an
extension
until
November
6,
2009.
5.
Further,
Respondent
requests
that
if
the
Hearing
Officer
grants
this
order,
that
Complainant’s
Reply
brief
due
date
be
extended
until
December
4,
2009
due
to
the
Thanksgiving
holiday.
6.
Packaging
has
confirmed
the above
with
attorney
for
Complainant;
and
the
Complainant
has
indicated
that
it
has no
objections
to
this request.
7.
The parties
will
be
not
prejudiced
by
extending
the due
date
for
the
additional
time
as
provided
above.
WHEREFORE,
for all
the
foregoing
reasons,
Respondent,
PACKAGING,
respectfully
requests
that
the
Hearing
Officer
grant
