ORDER OF THE BOARD (by G.T. Girard):
On July 23, 2009, at the parties’ request, the Board extended until October 7, 2009, the
time period for the City of Chicago Department of General Services (City) to appeal a June 2,
2009, determination of the Illinois Environmental Protection Agency (Agency).

5/40(a)(1) (2006); 35 Ill. Adm. Code 105.406. The determination concerns the City’s
underground storage tank (UST) site 1501 W. Pershing Road, Chicago, Cook County. The
Agency rejected the City’s Site Investigation Completion Report regarding the City’s UST site.
Because the City failed to timely file an appeal, the Board dismisses this case and closes the
docket.
