HEARING OFFICER ORDER
On October 1, 2009, all parties participated in a telephonic status conference with
the hearing officer. Discussions centered on the respondent’s motion for an extension of
time to answer or otherwise plead filed September 28, 2009, and respondent’s motion for
reconsideration of the August 20, 2009, Board order.
Over complainant’s objection, the respondent’s motion for an extension of time
was granted. Respondent’s answer or other pleading is now due to be filed on or before
December 4, 2009. The due date for respondent’s answer or other pleading may need to
be revisited at the next telephonic status conference.
Complainant requested an enlargement of time to respond to respondent’s motion
for reconsideration. Respondent did not object. Complainant’s response is now due to be
filed on or before October 23, 2009.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on November 19, 2009, at 11:30 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
