    On September 10, 2009,
    all parties participated
    in a telephonic status conference with
    the
    hearing officer. The complainant
    represented
    that a
    second draft stipulation and proposal for
    settlement has been circulated
    for review and for
    comments. Settlement discussions continue.
    To that end,
    the respondent’s answer or
    other pleading is now due to be filed on
    or
    before
    November 17, 2009.
    The
    parties or their
    legal representatives are
    directed to appear at a telephonic status
    conference with
    the hearing officer on October 29,
    2009, at 9:15 a.m. The telephonic
    conference
    must
    be
    initiated
    by the complainant, but
    each party is nonetheless responsible
    for its own
    appearance. At the conference the parties
    must
    be prepared to discuss
    the status of the above-
    captioned matter and their readiness for
    hearing.
