    Jean,
Thanks for the note. The case you are describing appears to be PCB 05-193. If
    you go
    to our website (address
below) you can search the Clerk’s Office On-Line (COOL) and pull up the files on that
    case.
    Carol
    Webb is
    the
    Hearing
Officer, and she can give you more detail on the
    status of the case.
I haven’t had any Calhoun peaches this year, so eat a few for me. I also miss the whole hog sausage
    from the
    Red
    &
White (I hope they still make it every Wednesday). Hopefully, Suellen and I
    can enjoy dinner at
Wittmond’s Hotel sometime this next year.
We moved to Morrison last year, where Suellen is Superintendent of the Morrison School District.
    Since we are
almost in Iowa, it probably explains why our paths haven’t crossed in awhile.
    If you
need more procedural info, please let me know.
    Sincerely,
    Tanner

    Hi Tanner,
    it’s been a while!
    I hope you are
    doing well.
    Life
    has sure been
    interesting in agriculture
    lately
    with
    the
    price
    swings
    on inputs
    and the late planting season.
    But usually,
    we are often
    thankful
    at
    harvest
    because
    crops more
    often
    than
    not do better
    than we expect.
    I
    have
    a question for you
    or the IPCB staff. There
    has been
    a case before PCB
    for some time regarding
    a
    spray
    drift
    complaint
    against
    Wabash
    Valley Service Company
    down in Hamilton
    County.
    The plaintiff’s name
    is
    Zofeldt. I wanted to let
    you
    know,
    if
    it’s of any consequence,
    that USEPA
    also investigated
    this last
    year
    and
    droppedil
    charges.
    Then,
    the case went
    to
    civil
    court in Hamilton
    County in
    July 2009.
    After
    a two week
    trial,
    the
    jury
    acquitted
    Wabash
    Valley
    on all charges after
    deliberating
    only
    1.5
    hours.
    I don’t know if these
    outcomes
    have ary relevance when
    it
    comes
    to the PCB deciding on
    whether to address
    the
    case,
    but I wanted
    to share
    these
    developments with
    you. From what I
    understand, there was
    no
    evidence
    presented
    that
    could link
    any
    of
    the plaintiff’s
    claims to pesticide
    drift.
    If you could share
    any insight on the future
    of this
    possible
    case before the PCB
    I
    would appreciate
    it.
    Hope
    all
    is well
    and that our paths cross
    soon. My husband
    and I are
    headed to Brussels for
    the
    St. Mary’s
    Church
    Picnic this weekend
    as well as to bring
    home lots
    of peaches for our friends.
