recommendation regarding the tax certification of water pollution control
facilities pursuant
to 35 Ill. Adm. Code 125.204.

Livestock waste management facilities consisting of one concrete pit(81 ft. x 236
ft. x 8ft. deep) and the portion of the plastic and case iron slotted flooring over
the manure pit in Building #
1; one concrete pit (77 ft. x 720 ft. x 10ft. deep) with
twenty concrete pump out pits (each 4 ft. x 4
ft. 10 ft. deep) and the portion of the
concrete slotted flooring over the manure pits in Building # 2; one concrete pit

ft. x 771 ft. x2 ft. deep) and the portion of the plastic and cast iron slotted
flooring over the manure pit in Building #3; one concrete pit (77 ft. x

These livestock waste management facilities are used to collect, transport and/or
store livestock wastes prior to cropland application, and are further described in
Exhibit
A.

Section 11-10 of the Property Tax Code, 35 ILCS 200111-10 (2006), defines
"pollution control facilities" as:
"any system, method, construction, device or appliance appurtenant
thereto or any portion
of any building or equipment, that is designed,
constructed, installed or operated for the primary purpose of: (a)
eliminating, preventing, or reducing air or water pollution
... or (b)
treating, pretreating, modifying or disposing
of any potential solid, liquid
or gaseous pollutant which
if released without treatment, pretreatment
modification or disposal might be harmful, detrimental or offensive to
human, plant or animal life, or to property."

Pollution control facilities are entitled to preferential tax treatment, 35 ILCS
200/11-5.

Based on the information in the application and the purpose of the facilities, it is
the Illinois
EPA's engineering judgment that the described facilities may be
considered
"pollution control facilities," pursuant to 35 Ill. Adm. Code
125.200(a), with the primary purpose
of eliminating, preventing, or reducing
water pollution, or as otherwise provided in
35 Ill. Adm. Code 125.200, and are
eligible for tax certification from the Board.
WHEREFORE, the Illinois EPA recommends that the Board issue the

Based on the information included in this submittal, it
is our engineering judgment that the above proposed facilities
may be considered "Pollution Control Facilities" under 35 lAC 125.200(a), with the primary purpose of eliminating,
preventing,
or reducing water pollution, or as otherwise provided in this section, and therefore eligible for tax
certification from the Illinois
Pollution Control Board. The Bureau of Water therefore recommends that the Board
issue the requested tax certification for these facilities.

water operations are related, file two applications. If attachments are

North Fork Pork LLC is a swine fann with 4 separate buildings.
EaCh of these building has manure storage capacity in below ground level concrete pits.
Also integrated into the design is specially designed flooring material that separates the
animals from the manure holding area yet allows the manure to pass
thru
the floor into
the holding area There are multiple types of flooring in use at this location Building 1
has some slatted flooring that is made from plastic and some made from steel reinforced
concrete slats. Building 3 also uses a similar type of slatted plastic flooring and a slatted
cast iron floor in a portion of the bldg. Buildings 2
&
4 exclusively use steel reinforced
concrete slats for flooring to efficiently allow manure to pass into the manure storage
area
Building 3 (from diagram below) has a manure pit that drain into,
thru
underground
piping,buildings 2 & 4. This sewer line is made of 8" PVC pipe that is approx 50 feet
long, the distance between buildings. Buildings 2
&
4 have deep concrete (8'
&
10') pits
below them that will retain approx 12 months worth of manure produced by the animals
at the fann. Manure is retained by these structures to prevent it from leaving the fann
and reaching surrounding water sources. The nearest body of water is approx 1/8 mile
from the nearest building. Multiple times each year the manure is pl,llllped out of the pits
and injected into surrounding fannland at agronomical appropriate rates. Each of the
buildings with deep pits has multiple pump out locations located on the longer sides of
the buildings. These pUmp out locations are approx 4 feet square and are made of
concrete
&
steel. They are poured as floors and walls of the building are constructed.
This feature allows for portable pumps to be lowered into the pits from the outside of
building
Collection
efficiency of this design of pollution control facility is 100%.
On the accompanying diagram the buildings are identified as 1-4 with approx.
dimensions listed at the top of each. Arrows between buildings indicate the direction and
flow of manure from one building to another.
