MOTION FOR EXTENSION OF TIME
NOW COMES the Complainant, Peter Arendovich and moves this Pollution Control Board for
an extension of time to research and file a motion pursuant to 415 ILCS 5/31(d) and 35 ILCS
101.202. In support of this motion, the Complainant states as follows:
1.
The Complainant has received the motion from the Tollway Authority on July 17, 2009.
2.
Other residents along the corridor in the area have the same complaint against the
NOISE pollution violation 35 Ill Adm. Code, Subtitle H chapter I, section 900.102 as filed \in
case PCB 2009-102.
3.
The affected residents in the area are reviewing the option of retaining an attorney to
represent our case(s) as individuals or as a group.
4.
The Complainant has definitive data that supports the position that the Tollway is in
violation by not implementing the sound abatement set forth in the FEIS for this project.
5.
The Tollway has not followed through on the document of former Governor Edgar,
Head of the Tollway, stating “ the overall abatement benefits outweigh overall adverse effects
and cost “.
6.
The Complainant has the data to support his position as the sound emitted (energy) is
greater than allowed by the FHWA guideline.
7.
The Defendant will not be prejudiced if the motion for extension is granted.
8.
The Complainant is confident that he will be able to file for a hearing of the subject 35
Ill Adm.Code,Subtitle H,Chapter I Section 900.102 within 45 days or before September 15,
2009.
9.
This motion is not intended to delay this matter, but to allow other members of the
community to express their desire for relief to the noise pollution problem.
The Complainant, Peter Arendovich respectfully moves this HONORABLE BOARD to grant its
motion and allow an additional 45 days or less until September 15, 2009 to have a hearing.
