HEARING OFFICER ORDER
On July 16, 2009, all parties participated in a telephonic status conference with
the hearing officer. The petitioner represented that it appears that they have resolved all
of the substantive issues and that internal discussions involve amended budget issues.
The petitioner represented that it anticipates that within the next 7 days, it will
either file an open waiver of the statutory decision deadline or a motion to voluntarily
dismiss.
The parties or their legal representatives are directed to participate in a telephonic
status conference on September 24, 2009, at 9:00 a.m. The status conference must be
initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to
voluntarily dismiss is filed prior to the status conference, the conference will be cancelled
without further notice.
