On February 18, 2009, petitioner L. Keller Oil Properties, Inc. (Charleston) (Keller) filed
a Motion to Dismiss Appeal (Mot.). Keller states that it “moves to dismiss the appeal pending
before the Board in this matter, on the grounds that the matter has been settled to the satisfaction
of the parties.” Mot. at 1. The Board grants the motion to dismiss, dismisses the pending appeal,
and closes the docket.
