PROTECTION AGENCY DECISIONS
Randy’s Shell, by its attorney, Carolyn S. Hesse of Barnes & Thornburg, pursuant to the
Illinois Environmental Protection Act, 415 ILCS 5/1
et. seq.
(the “Act”) and 35 Illinois
Administrative Code Section 105.400
et. seq.,
hereby appeals certain decisions by the Illinois
Environmental Protection Agency (the “Agency”).
1.
L. Keller Oil Properties, Inc. (“Petitioner” or “Randy’s Shell”) is the
owner of property referred to as Randy’s Shell located at 249 South
Macon Street in Bement, Piatt County, Illinois. The site was a gasoline
service station that had underground storage tanks (USTs) on the property,
which stored gasoline and diesel fuel.

LUST Incident Number 892516 was obtained following a site
investigation. LPC #1l90850001-Piatt County has also been assigned.

On May 13, 2004, Petitioner sent to the Agency a High Priority Corrective
Action Plan Budget (the “Budget”) to perform corrective action at the
Station.

The Agency received this document on
May 17, 2004. The Budget included signed certifications to the effect that

the submitted Budget complied with the Environmental Protection Act.

On July 8, 2004, the Agency sent a letter to Petitioner rejecting the High
Priority Corrective Action Plan Budget (the “Letter”).

Exhibit 2.)
The Letter stated as follows:
The Budget is rejected for the reasons(s) listed in Attachment A
below (Section 57.7(c)(4) of the Act and 35 Ill. Adm. Code
732.405(c) and 732.503(b)).

Attachment A to the Letter states in part:
The Illinois EPA previously notified the owner or operator of its
final action. Further, in accordance with 57.7(c)(4) of the Act and
35 Ill. Adm. Code
732.503(f),
the Illinois EPA’s action to reject or
require modification of the plan or budget, or the rejection of any
plan or budget by operation of law, was subject to appeal to the
Illinois Pollution Control Board within 35 days after the Illinois
EPA’s final action.
The Letter also states that Petitioner has the right to appeal this
decision to the Illinois Pollution Control Board.

The Agency’s Letter provides no additional information regarding why
IEPA disapproved the Budget.
7.
Petitioner is appealing the Agency’s decision Letter dated July 8, 2004.

The parties timely filed a joint notice to extend the 35-day period to file
this appeal.

By Order dated August 19, 2004, the Illinois Pollution Control Board
extended the appeal period to November 12, 2004.

Petitioner’s submittal dated May 13, 2004 to the Illinois EPA included a
detailed budget.

The letter from Petitioner’s consultant to the Agency dated May 13, 2004
that forwards the Budget sates in part:
•The approved costs have been reassessed and found to be
insufficient to complete the work required as described below.

It has been determined that the remaining requested amount will be
necessary in order to complete the approved work in accordance
with the regulations.

Section 732.405(e) provides as follows:
e)
If, following approval ofany groundwater monitoring plan,
corrective action plan or associated budget plan, an owner
or operator determines that revised procedures or cost
estimates are necessary in order to comply with the
minimum required activities for the site, the owner or
operator shall submit, as applicable, an amended
groundwater monitoring plan, corrective action plan or
associated budget plan for review by the Agency. The
Agency shall review and approve, reject or require
modifications of the amended plan in accordance with the
procedures contained in Subpart E ofthis Part.

Petitioner’s Budget provides costs that are necessary to comply with the
Act.
14.
Under the terms of Section 732.405(e), the Agency is required to review
the Budget in accordance with the procedures contained in Subpart E of
Part 732. Illinois EPA has failed to perform the detailed review required
by Subpart E, Section 732.505.
15.
Petitioner has determined that revised cost estimates are necessary in order
to comply with the minimum required activities for the site and that the
costs IEPA previously approved are not adequate to allow Petitioner to

comply with the Act or to perform the work described in the approved
modified CAP.
16.
Petitioner’s costs to perform the work as set forth in the Budget are
reasonable costs.
WHEREFORE, Randy’s Shell respectfully requests that the Board enter an order that
will require IEPA to approve the Budget and that Petitioner be reimbursed from the UST Fund
for the costs to do the work covered by the Budget, and for its attorneys’ fees and costs in
bringing this appeal.

LUST Technical Reports—Amended Corrective Action Budget
Dear Mr. Barrett:
This budget amendment is being submitted in response to the Agency’s letter dated January 13,
2004. The approved costs have been reassessed and been found to be insufficient to complete
the work required as described below. Since the deductions were not made to a level of detail
which indicates either hours or rates that were deducted, the budget amendment includes a
complete estimate of the required costs and subtracts out the previously approved amounts on
the B-i page.
Following our review of the deductions and the associated budget, adjustments have been
made. Specifically, the landfill costs.and personnel was adjusted to lower the overall proposed
personnel costs from the originally proposed budget. It has been determined that the remaining
requested amount will be necessary in order to complete the approved work in accordance with
the regulations.
Following completion of the soil excavation, the remaining groundwater contamination will be
re-assessed and a corrective action plan for groundwater, or a closure report will be prepared.

Control Board (“Board”)

November 11, 2004, a State holiday, and November 12th is the next business day. In support

Illinois EPA respectfully states as follows:

On July 8, 2004, the Illinois EPA issued a final decision to the Petitioner.

On July
15,
2004, the Petitioner made a written request to the Illinois EPA for an
extension oftime by which to file a petition for review, asking the Illinois EPA join in requesting
that the Board extend the thirty-five day period for filing a petition to ninety days.
The
Petitioner’s documents indicate that the final decision was received on July 9, 2004. (Exhibit B)

The additional time requested by the parties may eliminate the need for a hearing
in this matter or, in the
alternative,
allow the parties to identify issues
and limit the scope of any
hearing that may be necessary to resolve this matter.
WHEREFORE,
for the reasons stated above, the parties request that the Board, in the

and judicial economy, grant this request for a ninety-day extension of
the thirty-five day period for petitioning for a hearing.

On July 8, 2004, the Agency issued a letter
with respect to the above-referenced
LUST Incident. A new, amended High Priority Corrective Action Plan and Budget were
submitted to the Illinois Environmental Protection Agency dated May 13, 2004. This was
received by the Illinois EPA on May 17, 2004. The document was submitted pursuant to 35
IAC Section 732.405(e) which states as follows:
If, following approval of any groundwater monitoring plan, corrective action
plan or associated budget plan, an owner or operator determines that revised
procedures or cost estimates are necessary in order to comply with the
minimum required activities for the site, the owner or operator shall submit, as
applicable, an amended groundwater monitoring plan, corrective action plan or
associated budget plan for review by the Agency. The Agency shall review
and approve, reject or require modifications of the amended plan in
accordance with the procedures contained in Subpart E ofthis Part.

It appears that the Agency did not review these documents
in accordance with the procedures
contained in Subpart E. A copy ofthe letter from the Agency is
attached.
Randy’s Shell believes that, based upon discussions with Illinois Environmental
Protection Agency and
for other reasons, that we will be able to resolve the issues raised in
the Agency’s letter. However, we believe that we will not be able to resolve these issues by
the deadline for filing an appeal ofthese issues to the Illinois Pollution Control Board. Thus,
this is
a request for a 90-day extension pursuant to the Illinois Environmental Protection
Act
Section 40(a)(1) and 35
IAC 105.406
to
allow us to continue these discussions and to
try
to
resolve this issue.
If, for any reason, the Agency will not seek the 90-day extension, please notify me
immediately so that I may file the appeals to the Board. If you have any questions or
