HEARING REPORT
On November 14, 2006, a hearing in this matter was held at City Hall in Pekin, Tazewell
County. Attorney Michelle Ryan appeared on behalf of the complainant. Respondent appeared
pro se

Witness Credibility
Two witnesses testified during the hearing:
Mr. Eugene Figge
Mr. Stacy Hess
Based upon my legal judgment, experience, and observations at hearing, I find that the
credibility of witness is not an issue in this matter.
Exhibits
Exhibit 1 is complainant’s open dump inspection checklist dated December 21, 2004.
Exhibit 2 is respondent’s notice of sale of the property. There are three properties listed in
Exhibit 2, and property number 2 is the site that is the subject of this case. Both exhibits were
admitted into the record.
Briefing Schedule
The transcript is due by November 28, 2006. Complainant will file its brief by
December 19, 2006. Respondent’s brief is due by January 17, 2007. Complainant’s reply, if
any, is due by January 24, 2007. The mailbox rule will apply.
