    HEARING REPORT
    On November 17, 2005, a hearing in this matter was held at the Perry County Courthouse
    in Pinckneyville, Illinois. Attorney Michelle Ryan appeared on behalf of the complainant.
    Attorney Kevin Babb appeared on behalf of the respondent.
    Witness Credibility
    3 witnesses testified during the hearing:

    Mr. William Shrum
    Mr. Keith Moss
    Based upon my legal judgment, experience, and observations at hearing, I find that the
    credibility of witness is not an issue in this matter.
    Exhibits
    The complainant offered two exhibits as evidence at hearing. Exhibit 1 consists of
    photographs of the site, and Exhibit 2 is the open dump inspection checklist. Respondent did not
    object, and both exhibits were admitted as evidence.
    Briefing Schedule
    The transcript is due by December 1, 2005. Complainant’s brief is due by December 29, 2005,
    and respondent’s brief is due by January 26, 2006. Complainant’s reply, if any, is due by
    February 2, 2006.
