Respondent, Illinois Environmental Protection Agency, by LisaMadigan,
Attorney General ofthe State ofIllinois, moves the Hearing Officer, pursuant to Board
Procedural Rule 101.522, to grant a two-week extension oftime to file its response to
Petitioner Midwest Generation’s Motion for Partial Reconsideration ofthe Illinois
Pollution Control Board’s Order of June 1, 2004. In support ofthis Motion, Respondent
states as follows:

Pursuant to 35 Ill. Adm. Code 101.500, the Respondent Agency’s
response to Petitioner Midwest Generation’s Motion for Partial Reconsideration ofthe
Illinois Pollution Control Board’s Order ofJune 1, 2004 in the captioned proceeding is
currently due to be filed September 7, 2004.

Vacation schedules ofpersonnel at the Respondent Agency who are
involved with this matter preclude filing by the current deadline.
3.
Counsel for Petitioner Midwest Generation has consented to this extension
oftime.
4.
Accordingly, Respondent respectfully requests that it be granteduntil
September 21, 2004 to file its response to Midwest Generation’s motion.
