HEARING OFFICER ORDER
On May 8, 2008, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they anticipate filing an agreed motion to
stay these proceedings within the next 30 days while they continue settlement
discussions. The respondent represented that there is a related case with the United
States Environmental Protection Agency that is on the same track. The petitioner
represented that it will file an additional six-month waiver of the statutory decision
deadline.
