HEARING OFFICER ORDER
On April 24, 2008, the parties informed the hearing officer that the United States
Environmental Protection Agency has yet to rule on the related confidentiality issues.
The Board on November 15, 2008, granted the parties’ joint motion to stay the
above-captioned proceedings to an including April 17, 2008. In light of the expiration of
the Board’s stay order, the parties requested that the status conference be continued so
that they may discuss how to proceed with this matter, including the possibility of
submitting a proposed discovery schedule.
