NOW COMES Petitioner, SUTTER SANITATION, iNC., by and through its attorneys,
Sorling, Northrup, Hanna, Cullen & Cochran, Ltd., Charles J. Northrup, ofcounsel, and pursuant
to 35 Ill. Adm. Code 101.308 waives the Pollution Control Board’s (“Board”) deadline for final
action in this matter until February 28, 2005 In support Petitioner states:

The above-captioned permit appeal was filed with the Board on or about April 26.
2004. The current decision deadline is December 31, 2004.
2.
Inorder for Petitioner to pursue settlement with the illinois Environmental Protection
Agency, additional time beyond the current decision deadline is required.
